Terms of Service

1. Agreement to Terms

By accessing or using Dafty (“the Service”), operated from the United Kingdom, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Dafty is an image generation platform that allows users to sketch ideas and transform them into production-quality visuals. The Service operates on a usage-based model and relies on third-party AI models to generate images.

3. Account and Access

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Usage-Based Billing

The Service is billed on a usage basis according to the plan you select. Usage limits, pricing, and plan features are described on our pricing page and may change with reasonable notice.

All fees are non-refundable except where required by applicable law. If your usage exceeds your plan allowance, additional usage may be restricted until the next billing cycle or until you upgrade your plan.

5. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or exploitative content
• Infringe on the intellectual property rights of any third party
• Attempt to reverse-engineer, extract, or replicate the underlying AI models
• Overload, disrupt, or interfere with the Service or its infrastructure
• Resell access to the Service without written permission

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Intellectual Property

You retain ownership of the sketches and input you provide. Subject to compliance with these Terms, you are granted a licence to use the images generated by the Service for personal and commercial purposes.

Dafty does not claim ownership of your generated content. However, we make no warranty that generated outputs are unique or free from resemblance to other works, given the nature of AI-generated media.

7. Third-Party AI Models

The Service relies on third-party AI model providers to generate images. We do not control these providers and accept no responsibility or liability for:

• Outages, downtime, or unavailability of third-party model providers
• Changes in output quality, speed, or latency caused by third-party providers
• Content filtering or moderation decisions made by third-party providers
• Any modifications third-party providers make to their models or services

We will make reasonable efforts to maintain service availability but cannot guarantee uninterrupted access where disruptions are caused by factors outside our control.

8. Service Availability and Warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. Generation results may vary and are not guaranteed to meet specific expectations.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Dafty and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Dafty and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the email address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, or for any other reason at our discretion with reasonable notice where possible.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
